1. Scope & Applicability

These general terms and conditions apply to all purchases made through the Johst GmbH online shop (https://cavitationplate.com/).

2. Conclusion of the Contract

The product descriptions in the online shop do not represent binding offers; they are invitations for the customer to submit a binding offer. By completing the order process, the customer makes a binding offer to conclude a sales contract for the products in the shopping cart.

3. Prices and Payment

All prices quoted on our website include the statutory value-added tax. Delivery and shipping costs are not included in the purchase price and are to be borne by the customer unless otherwise agreed. Payment can be made using one of the methods mentioned in our online shop.

4. Delivery and Shipping

Goods will be shipped to the address provided by the customer unless otherwise agreed. Information about delivery times is non-binding, unless the delivery date has been promised as binding in exceptional cases.

5. Retention of Title

The goods remain the property of Johst GmbH until the purchase price has been paid in full.

6. Warranty

Claims for defects by the customer are governed by the statutory provisions within the framework of the Austrian Consumer Protection Act, unless otherwise specified in the following. If an exchange, improvement, or price reduction is impossible or disproportionate, the customer is entitled to a refund.

7. Liability

Johst GmbH is liable according to the legal provisions, unless otherwise stated in these terms and conditions.

9. Final Provisions

If individual provisions of these general terms and conditions are ineffective, this does not affect the binding nature of the remaining provisions and the contracts concluded on the basis of the same. The ineffective provision is to be replaced by an effective one that comes closest to the economic purpose and the mutual will of the parties.

10. Governing Law and Jurisdiction

Austrian law applies to the exclusion of the UN sales law. The place of jurisdiction is Handelsgericht Klagenfurt.
